Can a foreign national file for divorce in Turkey?

A foreign national may be able to file for divorce in Turkey if Turkish courts have jurisdiction. The spouses’ nationalities, habitual residences, place of residence and other international elements must be examined before filing.

What is the difference between contested and uncontested divorce?

In an uncontested divorce, the spouses agree to divorce and reach an agreement on its financial consequences and the position of any children. If agreement cannot be reached on the divorce or its consequences, the case proceeds as a contested divorce.

What are the requirements for an uncontested divorce in Turkey?

The marriage must have lasted for at least one year. The spouses must apply together or one spouse must accept the other’s case, agree on the financial consequences and arrangements concerning the children, and personally confirm their free consent before the judge.

Can one spouse obtain a divorce if the other spouse does not agree?

Yes. The other spouse’s consent is not required for a contested divorce. The spouse seeking divorce must rely on a legally recognised ground and present the relevant facts and evidence to the court.
