Frequently Asked Questions About Criminal Law in Turkey

What is the difference between a suspect and a defendant?

A person under suspicion during the investigation stage is referred to as a suspect. Once the indictment has been accepted and the prosecution stage has begun, that person is referred to as a defendant.

Is it mandatory to have a lawyer in criminal proceedings?

You should determine which authority issued the summons and the investigation to which it relates. Before giving a statement, you have the right to be informed of the allegation, remain silent and receive legal assistance from a lawyer.

Can a statement given without a lawyer be changed later?

A suspect or defendant may provide further explanations or correct an earlier statement during subsequent stages. However, inconsistencies between statements may be considered when the evidence is assessed, so the reasons for any changes should be clearly explained.

Does an arrest order mean that the person is guilty?

No. Pre-trial detention is a temporary procedural measure that may be imposed only when the statutory conditions are met. The presumption of innocence continues to apply unless and until a conviction becomes final.

Can arrest or judicial control measures be challenged?

Does withdrawing a complaint always end the criminal case?

No. The effect of withdrawal depends on whether prosecution of the alleged offence requires a complaint and on the stage of the proceedings. Withdrawal does not automatically terminate proceedings for offences prosecuted ex officio.

Can WhatsApp messages and social media records be used as evidence?

Messages and social media records obtained lawfully may be considered as evidence. Their source, integrity, connection to the relevant person and method of acquisition must be assessed in the circumstances of the case.

Can a secretly recorded conversation be used as evidence?

The legal status of a covert recording depends on the circumstances and how it was obtained. As making an unlawful recording may itself result in criminal liability, it should not be assumed that every secret recording can be used as evidence.

How long do criminal proceedings take in Turkey?

There is no fixed duration applicable to every criminal case. The nature of the allegation, number of parties and witnesses, expert examinations, evidence collection, court workload and appeal stages may affect the overall timeline.

Can a criminal court decision be appealed?
